The Role Location Plays in Divorce

That article also ranked all 50 states on the ease of divorce. In this study the state of Georgia ranked 23 with a divorce rate of 11.6%. In fact, Georgia has specific requirements which directly impact the divorce decision. For instance,

  • A divorce in the state of Georgia will be handled in the Superior court within the county where you live or where your spouse lives.
  • Divorce laws apply only to the residents of a state and each state has its own residency requirements. In Georgia, the residency requirement is six months.

Grounds for divorce in Georgia include the following:

  • Impotence
  • Adultery
  • Imprisonment of over two years
  • Willful desertion
  • Fraud, duress or force
  • Mental capacity/ insanity
  • Incest
  • Pregnant by another at the time of marriage unknown to spouse
  • Additionally, adultery is a bar to alimony in the state of Georgia
  • There is a waiting period of at least 30 days for a divorce filed on the grounds of the marriage being irretrievably broken. This waiting period is typically extended to 120 days in the event the couple has children.
