How is an alimony request treated?

Alimony can be an important request during any divorce, as one spouse may need alimony payments and the other spouse may be concerned they cannot afford to pay alimony payments. For that reason, spouses going through a divorce should know what factors are used to consider an alimony request.

Factors used to determine alimony

There are several factors that are evaluated that my influence an alimony determination including:

  • The standard of living established during the marriage;
  • The duration of the marriage;
  • The age and physical and emotional conditions of both spouses;
  • The financial resources of each of the spouses;
  • When necessary, the time necessary for either of the spouses to acquire sufficient education or training to allow them to obtain appropriate employment;
  • The contributions of each spouse to the marriage, including homemaking and childcare services;
  • The contributions of each of the spouses to the education or career building of the other spouse;
  • The condition and financial situation of each of the spouses, including the separate estates, earning capacities and liabilities of each of the spouses; and
  • Other relevant factors the court views as equitable and proper to make a determination of alimony.

The question of whether or not alimony will be granted, for how much and for how long is an important question during many divorces that may be high on the list of concerns for the divorcing spouses. It is helpful for divorcing spouses to be prepared for how to navigate an alimony request made by either spouse and to know what to expect once one has been made.
